Agreement Between User and Colt Melrose Photography
Welcome to coltmelrosephotography.com (the “Site”). The Site is operated by Colt Melrose Photography, a professional photography studio located in Houston, Texas. By accessing or using this Site, booking our services, or submitting any inquiry, you agree to be bound by the terms and conditions set forth below (the “Terms”). Please read them carefully. If you do not agree to these Terms, do not use the Site or engage our services.
These Terms apply to all visitors, clients, and prospective clients who access or use the Site in any manner.
1. Nature of Services
Colt Melrose Photography provides professional photography services, including but not limited to business headshots, personal branding photography, corporate photography, and family portraits. The Site is used to provide information about our services, facilitate booking and inquiry submissions, and support client communications.
By submitting a booking request, completing a contact form, or engaging with our booking system, you acknowledge that you are initiating a service relationship with Colt Melrose Photography subject to these Terms and any additional written agreement or invoice provided at the time of engagement.
2. Booking, Deposits & Payment
The following policies apply to all bookings made through the Site or directly with Colt Melrose Photography:
Booking Confirmation
A session is not confirmed until a signed agreement and deposit payment have been received. Submitting an inquiry or booking request does not guarantee availability or reserve your session date.
Deposit
A non-refundable deposit is required to secure your session date. The deposit amount will be specified in your booking confirmation or invoice. This deposit is applied toward your total session fee.
Remaining Balance
The remaining balance is due in full prior to or on the day of your session, unless alternate payment terms have been agreed upon in writing.
Cancellation & Rescheduling
We understand that schedules change. The following cancellation and rescheduling policies apply:
- Cancellations made 72 hours or more before your scheduled session: your deposit may be applied toward a rescheduled session at Colt Melrose Photography’s discretion.
- Cancellations made fewer than 72 hours before your scheduled session: the deposit is forfeited and a new deposit will be required to rebook.
- Same-day cancellations or no-shows: the full session fee may be charged at Colt Melrose Photography’s discretion.
- Rescheduling requests made 72 hours or more in advance will be accommodated, subject to availability, at no additional charge.
Refund Policy
All deposits are non-refundable. Refunds on session fees are not provided once a session has been completed. If you are dissatisfied with your experience, please contact us directly at co**@********************hy.com, and we will work in good faith to address your concern.
3. Image Licensing & Intellectual Property
Copyright Ownership
All photographs, images, and visual content created by Colt Melrose Photography remain the exclusive intellectual property of Colt Melrose Photography. Copyright vests in Colt Melrose Photography upon creation of the work, regardless of the subject matter or the client commissioning the session.
License Granted to Clients
Upon receipt of full payment, Colt Melrose Photography grants you a non-exclusive, non-transferable, royalty-free license to use the delivered images for personal and professional purposes, including but not limited to use on LinkedIn, professional websites, business cards, marketing materials, email signatures, press materials, and social media profiles. This license does not include the right to resell, sublicense, or transfer the images to any third party for commercial exploitation without prior written consent from Colt Melrose Photography.
Portfolio and Marketing Use
Colt Melrose Photography retains the right to use images created during any session for portfolio display, website content, social media, marketing materials, editorial use, and professional awards submissions. If you require that your images not be used for marketing purposes, you must submit a written request prior to your session. Colt Melrose Photography will honor reasonable confidentiality requests but cannot guarantee removal of images that have already been published.
No Unauthorized Use
You may not alter, edit, apply filters to, or otherwise modify the delivered images in a manner that misrepresents the work of Colt Melrose Photography without prior written consent. You may not remove or obscure any watermarks or copyright notices embedded in or accompanying delivered files.
Site Content
All content on the Site — including text, graphics, logos, images, and the compilation thereof — is the property of Colt Melrose Photography or its licensors and is protected by applicable copyright, trademark, and intellectual property laws. You may not reproduce, distribute, transmit, or create derivative works from any Site content without express written permission.
4. Privacy & Data Collection

IN THE EVENT OF ANY CLAIM ARISING FROM A COMPLETED PHOTOGRAPHY SESSION, COLT MELROSE PHOTOGRAPHY’S TOTAL LIABILITY SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU FOR THE SESSION IN QUESTION. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY; IN SUCH CASES, THE ABOVE LIMITATIONS APPLY TO THE FULLEST EXTENT PERMITTED BY LAW.
10. Indemnification
You agree to indemnify, defend, and hold harmless Colt Melrose Photography and its officers, principals, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney’s fees) arising out of or related to: (a) your use of the Site or services; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any content you submit or provide in connection with your use of the Site.
11. Governing Law & Jurisdiction

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
